Under Clauses 26 and 27 of the Water Industry Competition (General) Regulation 2008, the Minister for Water may establish a Marketing Code of Conduct and a Transfer Code of Conduct.
The Marketing Code of Conduct will set the standards of conduct for marketers representing licensed retail suppliers and the minimum level of information to be provided to customers.
The Transfer Code of Conduct will regulate the process for the transfer of customers from one licensed retail supplier to another.
The NSW Office of Water has prepared a Draft Marketing Code of Conduct and a Draft Transfer Code of Conduct for stakeholder comment.
Community consultation
In April 2011, over 300 stakeholders were invited to comment on the draft codes. The Office of Water received 12 submissions from government and private agencies, seven of which are listed below.
Submissions received
Overall, there were no signification issues. Further to the feedback received, revisions will be made to a number of clauses to clarify their intent. The revised codes, once approved by the Minister, will be gazetted.
